KELLYFINE TERMS & CONDITIONS
Article 1 (Purpose)

These Terms and Conditions govern the rights, obligations, and responsibilities between KELLYFINE Co., Ltd. (hereinafter referred to as the “Company”), an e-commerce service provider, and users of the KELLYFINE online platform (hereinafter referred to as the “Mall”) with respect to the use of internet-related services provided by the Mall (hereinafter referred to as the “Services”).

These Terms shall also apply to electronic commerce conducted via PC communications, wireless devices, or other electronic means, insofar as such application does not conflict with the nature of the transaction.

Article 2 (Definitions)

“Mall” refers to the virtual business platform established and operated by the Company using information and communication facilities to enable transactions of goods or services (hereinafter “Products”) and also refers to the operator of such cyber mall.

“User” refers to any person who accesses the Mall and uses the Services provided by the Mall in accordance with these Terms, including Members and Non-members.

“Member” refers to a User who has registered an account with the Mall and is entitled to continuously use the Services.

“Non-member” refers to a User who uses the Services without registering as a Member.

Article 3 (Posting, Explanation, and Amendment of Terms)

The Mall shall display these Terms, the Company’s name, representative’s name, business address, customer service contact information, business registration number, mail-order business registration number, and personal data protection officer on the initial service screen of the Mall so that Users can easily access such information. These Terms may be made available via a linked page.

Prior to a User’s agreement to these Terms, the Mall shall provide a separate screen or pop-up to explain important matters such as withdrawal of subscription, delivery responsibility, and refund conditions.

The Mall may amend these Terms to the extent permitted by applicable laws, including but not limited to:

Act on Consumer Protection in Electronic Commerce

Act on the Regulation of Terms and Conditions

Framework Act on Electronic Documents and Transactions

Electronic Financial Transactions Act

Personal Information Protection Act

In the event of amendment, the Mall shall announce the effective date and reasons for amendment at least 7 days prior to the effective date (30 days for amendments unfavorable to Users), clearly comparing previous and revised Terms.

Amended Terms shall apply only to contracts entered into after the effective date unless an existing User expressly agrees to the amended Terms.

Matters not stipulated herein shall be governed by applicable laws, regulations, and customary commercial practices.

Article 4 (Provision and Modification of Services)

The Mall provides the following Services:

Information on Products and conclusion of purchase contracts

Delivery of purchased Products

Other services determined by the Mall

The Mall may modify Product details in cases of out-of-stock items or changes in technical specifications and shall notify Users immediately.

If a contracted Service is modified due to unavoidable circumstances, the Mall shall notify the User without delay.

The Mall shall compensate Users for damages incurred due to such changes unless the Mall proves the absence of intent or negligence.

Article 5 (Suspension of Services)

The Mall may temporarily suspend Services due to maintenance, replacement, malfunction of information facilities, or communication failures.

The Mall shall compensate for damages unless it proves no fault.

If Services are terminated due to business restructuring or closure, the Mall shall notify Users and provide compensation according to announced standards.

Article 6 (Membership Registration)

Users may apply for membership by completing the registration form and agreeing to these Terms.

The Mall may reject registration if:

False information is provided

The applicant previously lost membership qualification

Technical issues prevent registration

Membership is effective upon confirmation by the Mall.

Members must promptly update any changes to their registration information.

Article 7 (Membership Withdrawal and Disqualification)

Members may withdraw at any time, and the Mall shall process the request immediately.

The Mall may restrict or suspend membership for:

False registration

Non-payment of obligations

Disruption of service or misuse

Illegal or immoral conduct

Membership may be revoked for repeated violations.

Prior notice and opportunity for explanation shall be provided.

Article 8 (Notification to Members)

Notifications shall be sent via the email address provided by the Member.

General notices may be posted on the Mall for at least one week.

Article 9 (Purchase Application and Consent to Personal Information Use)

Users apply for purchases through the Mall’s designated process.

Consent is required for third-party sharing or processing of personal data.

Data processing outsourcing shall be disclosed in the Privacy Policy.

User data may be transferred in case of hosting migration for service continuity.

Article 10 (Formation of Contract)

The Mall may refuse purchase requests if:

False information is provided

Restricted Products are purchased by minors

Technical issues occur

A contract is deemed concluded upon receipt of confirmation notice.

Article 11 (Payment Methods)

Payment may be made through:

Bank transfer

Credit/debit cards

Online deposits

Electronic currency

Points or coupons

Gift certificates

Other approved electronic payment methods

No additional fees shall be charged.

Article 12 (Order Confirmation and Modification)

The Mall shall send confirmation upon order receipt.

Users may modify or cancel orders prior to shipment.

Article 13 (Supply of Products)

Products shall be delivered within 7 days unless otherwise agreed.

Delivery details shall be clearly stated.

Article 14 (Refunds)

If Products cannot be supplied, refunds shall be processed within 3 business days.

Article 15 (Withdrawal of Subscription)

Users may withdraw within 7 days of receipt.

Withdrawal is restricted if Products are damaged or used.

Misrepresentation allows withdrawal within statutory periods.

Article 16 (Effect of Withdrawal)

Refunds shall be made within 3 business days.

Payment cancellation shall be requested immediately.

Return shipping costs are borne by the User unless the fault lies with the Mall.

Article 17 (Personal Information Protection)

The Mall shall collect minimal personal data, protect it securely, and dispose of it promptly after use in accordance with applicable laws.

Article 18 (Obligations of the Mall)

The Mall shall:

Operate legally and ethically

Maintain security systems

Refrain from unsolicited advertising

Article 19 (Member ID and Password)

Members are responsible for safeguarding their credentials and must notify the Mall of any unauthorized use.

Article 20 (User Obligations)

Users shall not:

Provide false information

Infringe intellectual property rights

Disrupt services

Post obscene or illegal content

Article 21 (Linked Malls)

The Mall is not responsible for transactions conducted on linked third-party websites.

Article 22 (Copyright and Use Restrictions)

All intellectual property belongs to the Mall unless otherwise stated. User-generated content may be used by the Mall for promotional purposes without compensation.

Article 23 (Dispute Resolution)

Disputes may be resolved through consumer mediation bodies or competent courts.

Article 24 (Reward Points Program)

The Mall may operate a points or coupon system under its policies. Points expire upon withdrawal or policy changes.

Article 25 (Jurisdiction and Governing Law)

All disputes shall be governed by the laws of the Republic of Korea, and jurisdiction shall be determined in accordance with civil procedure laws.

Addendum

These Terms shall take effect on [Effective Date].

KELLYFINE PRIVACY POLICY

KELLYFINE Co., Ltd. (the “Company,” “we,” “us,” or “our”) values your privacy and complies with applicable privacy laws and regulations, including the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Personal Information Protection Act of the Republic of Korea.

This Privacy Policy explains what personal information we collect, how we use it, and what measures we take to protect it. If we revise this Privacy Policy, we will notify you through the website notice board and/or individual notice (e.g., email or in-service notice), as required.

2. Purpose of Collection and Use

Order processing and delivery of products

Measuring website access frequency and service usage statistics

Sending promotional materials such as event and marketing information (where consent is required)

Member Data Migration in Case of Hosting Provider Change

Transfer and processing of member information for service continuity when changing hosting providers

Automatically collected information:
During your use of our Services, information such as service usage history, visit history, suspicious use history, IP address, cookies, and advertising identifiers may be automatically generated and collected.

Event participation:
Collected items may differ depending on the event. In such cases, we will obtain separate consent at the time of entry and destroy the information immediately once the purpose is achieved.

3. Retention and Use Period

We will destroy your personal information without delay once the purpose of collection and use has been fulfilled, unless retention is required by applicable laws or internal policies.

4. Procedures and Methods for Destruction
(1) Destruction Procedures

Information entered for membership registration, purchases, or inquiries is transferred to a separate database (or stored separately in paper form) after the purpose is achieved, then retained for a certain period in accordance with internal policies and applicable laws, and subsequently destroyed.

Personal information transferred to a separate database will not be used for purposes other than legal retention requirements.

(2) Destruction Methods

Electronic files: permanently deleted using technical methods that prevent restoration

Paper documents: shredded or incinerated

5. Provision of Personal Information to Third Parties

We do not provide your personal information to third parties in principle, except in the following cases:

Where you have provided prior consent

Where required by law or requested by investigative authorities in accordance with legal procedures

6. Outsourcing of Personal Information Processing (Data Processing Entrustment)

Note: Only the minimum information necessary to perform the outsourced tasks is shared. Depending on your service request, personal information may be selectively provided to the relevant providers.

The list of outsourced providers may change depending on service updates or contract terms. We will notify you in advance via the website notice board. For short-term events, we will provide a separate notice at the time of participation.

7. Protection of Children Under 14

We do not accept membership registrations from children under the age of 14, for whom consent from a legal guardian is required.

8. Cookies and Other Automatic Collection Technologies

We use cookies and similar technologies that store and retrieve information from time to time. Cookies are small text files sent by our server to your browser and stored on your device.
